SIDA Requirement

On applications they ask if you have any disqualifying convictions within the last 10 years for SIDA authorizations. I’m wondering if I should mention anything about something that shows up on my FBI database from 12-13 years ago? It’s not even a conviction but it looks bad being on there. It’s outside the range so do I need to/should I disclose if they don’t specifically ask?

SIDA is not like a military/IC or law enforcement background check... there's no subjectivity involved.

It's black and white, pass/fail.... either you were convicted of the specified crimes in the specified time frame or you were not.

Answer the questions literally, do not provide any more info than they ask for. For SIDA it won't matter.

For filling out job applications and interviews, it can be a little grey. Generally don't tell them anything they didn't ask for, but if it's a grey area it may be safer to disclose something than not.

But in some cases they would *like* to know more but employment law prevents them from asking. If you tell them anyway, they can use it to make their decision. Be careful of open-ended interview questions such as "is there anything else about your background you want to tell us"? Interview is not confessional. Don't provide any adverse info which they didn't ask for... you may have to use your judgement in a grey area.

Now a more specific question: What are your thoughts on FedEx’s questionnaire #40 “Is there any other information you feel warrants an explanation that you would like to note at this time?”

Do you think something in the FBI database warrants explanation if it isn’t a conviction OR within the last ten years?

Also, there is a certification statement at the end of the questionnaire that states:

“The information I have provided is true and complete to the best of my knowledge and belief. I understand that any misrepresentation or ommission of any fact or information I provide in connection with seeking employment may result in denial of employment or discharge.”

In my opinion an omission of the issue of concern from the FBI database isn’t “in connection with seeking employment”. Because:
1) outside 10 years
2) an issue of no disposition (only states the charge)
3) I’m working to have it removed/expunged but it seems like way too much to explain if they don’t ask
