Let’s be honest here, the airline managements hoped that 100% vaccination rates would be a PR coup and bring the pax back. Instead it threatens to be a multimillion dollar boondoggle and legal nightmare. Maybe they ought to rethink it.

Meh. Get a van, go on a long road trip, come back in a couple years when it's all over. Better than just getting canned, keep your career and your principles (at the cost of short-term pay).

And companies that DON’T run as lean an operation as LUV does might get away with that. But probably not.

No, OSHA has not yet issued the ETS for employers with 100+ employees requiring either vaccination or weekly testing.

That said, Southwest's mandate falls under Safer Federal Workforce Task Force guidance for government contractors per Biden's EO.

They will be required to reasonably accommodate. Putting employees on unpaid leave is likely not going to fly. Further, Biden’s mandate is still overreach and is likely getting shot down. He doesn’t have those authorities. One could argue the state does, but the fed certainly does not.

That may end up being how the courts rule. But if it were truly beyond dispute as you're stating, then this would never have gotten off the ground. The White House has legal counsel and DOJ attorneys that vet policy proclamations before they are issued. That was true of Trump's administration and it's true of Biden's administration now. People said Trump's Muslim ban was clearly unconstitutional, yet parts of it remained in effect into 2021.
