I'm sure it's out of context but I love the part where it says " refusing to accept voluntary or overtime flying"

Not sure how you can sue someone for that but I'm no rocket surgeon. I'm sorry for lurking in your garden, but this whole process is fascinating and I hope these greedy people get their feet held to the fire. I fully understand that managements job is to cut cost, but there is a line to where it goes counter productive. Something about not seeing the forest for the trees or whatever. Hang strong

Status Quo. DALPA lost a court ruling on this matter ~2004 and APA lost a court ruling on this ~2009. Legal precedent is in Spirit management's favor on this matter. Of course the intimidation campaign by some individuals didn't help SPA.

The actually TRO from the Judge basically states that it can't be a concerted effort by the pilot group. You can make your own choice to either pick up or not pick up open time, but you cant make it a concerted effort.

Ding ding ding! You got it! That's all it states. It's not a hammer, it's a piece of paper!! APC post are just fluff, the website posting didn't help the pilot group but you have to understand guys are getting ****ed that guys pull 150 to 200 hours of credit every month! That's the real problem and needs to be reeled in by the pilot group. Those are actual jobs and the union needs to protect the pilot group from this behavior.

Status quo is an interesting concept. The Delta issue came down to hard evidence by a few union officials pushing the "No OT" campaign coupled with a measurable decrease in voluntary overtime flying when compared year-over-year.

Absent the union intervention and "fingerprints," I think a Court would be hard-pressed to issue a TRO to compell pilots to fly voluntary overtime. TROs usually "stop" stuff rather than compell someone to do something....hence the "R" (Restraining) in TRO. Even with past practice (i.e., X amount of trips are covered by voluntary OT), are you obligated to fly over and beyond the terms of your contract? It becomes an interesting legal exercise.
