The burden of proof for a TRO is minimal. The company included anything that even possibly insinuated a work action. The problem we have here is simple. By accepting the TRO and allowing it to become permanent, the Spirit MEC allowed all of the unproven TRO "evidence" to become fact.
If youre interested in Spirit as a career, understand that the TRO directly affects you. Have fun with that $ 38/ hour pay and no chance for OT in the near/far future. The weak MEC condemed you to earning less to fly 228 people around than you can make in a 90 seat RJ.

Just because they decided to extend the TRO does NOT mean the "evidence" is now fact. We can easily decide to stop negotiating and go to court. The MEC has decided this is not the best course of action and rather than tie up ALPA funds and time in a finger pointing game we decided to comply and continue negotiating. If you really want CBA 2020 we can go ahead with your battle in court. This would most definitely extend the timeline to a new contract.

At this point, getting back to negotiations isn't happening either. With the mismanagement of this place, the operation will not return back to normal until the end of summer. Even bendo said the 4 day trips in open time are our fault. 4 day trips happen and sometimes end up in the open time. They could break the pairings so people could pick them up but they won't because they want the chaos. As of now, many people aren't even legal to pick them up. They don't want the operation to recover , so they can blame everything they have been so shortsighted about on the pilot group. They also get to delay negotiations because they blame us. So, for management, this is a win win scenario. Even if it costs the company money in the long run, they don't care. Long run losses for the company have no effect on short term bonuses for management.

this whole entire thing... The meltdown, the lawsuit, the tro, the letters that suddenly appear from a "caring" ceo, the wednesday podcast from bendo etc. It is all part of a negotiating strategy. They had that 200 pg document mostly finished prior to the first cancellation in early may. All strategy. This is what they want: Comments like yours show that it is working. First they create a division between us and other employees. Then division within our group.

What's really stupid is the result will be the same. Delay, delay, delay until it really is a cost neutral contract. Every year we have to ask for 10% more, and that figure came from the union. But hey, as long as the 1600 benefit the "55000" it's all good.
We certainly are managements wet dream!

100% of the "evidence" used by the company to get their TRO was harvested off of this website.
