Not if you only put 70 seats on them.

“70-Seat Aircraft” means aircraft configured with more than fifty (50) passenger seats but no more than seventy (70) passenger seats, and certificated in the United States with a maximum gross takeoff weight of 86,000 or fewer pounds.

That would be a waste of an airplane. I am betting that the Company has every intention of installing 76 seats because CASM makes the airplane not financially viable. It's barely viable at 76 seats.

The 170’s are under the weight limit, but the it looks like the new 175’s are not. Embraer has them listed as 89k on their website. Unless they make them lighter for us somehow.

Reports from the airshow the plane will be operated with 70 seats. They are fully aware of the contract.

Then you haven't been paying very close attention. All that would do is embolden the pilots AGAINST what management wants. They have already retreated on their momentary violation of two extra UAX aircraft.

Then why not order the EMB-170? That's a 70 seat airplane.

“76-Seat Aircraft” means aircraft configured with more than seventy (70) passenger seats but no more than seventy-six (76) passenger seats, and certificated in the United States for ninety (90) or fewer passenger seats and with a maximum United States certificated gross takeoff weight of 86,000 or fewer pounds.

To me it's a little worrisome that the Company is willing to commit to airplanes that are currently a violation of our Scope. I think that is a big gamble by the Company. I will not vote yes on any TA that contains any relaxation in Scope. I won't even read the rest of the TA because it will already be unsat.
