Default Memeroamdum of Understanding (MOU)

Memorandum****

Recently I left a 91K/135 to go to the airlines. Before I started there, I signed a MOU agreement that if I left within 18 months I had to pay back a pro-rated amount for training. I left 15 months in to better my career to go get an ATP and fly a multi engine plane. My question is... Can I legally get away without paying this back? They claim they will send it over to collections if not paid for. Has anyone on here experienced something like this before?

You agreed to pay it, so pay it.

How about you try not being a scumbag and repay the money like you promised. How would you like it if someone skipped the bill on you? I can't believe anyone would ask such a stupid question. You chose not to wait 3 months because you were so eager to "better your career". That's your d_mn problem.........and now you want to "GET AWAY" without paying them back???

What is wrong with you that you would even think about doing this? You made a commitment, put on your big boy pants and pay your damn bills.

You seriously enter here to ask how you can skate out of honoring your obligations?

You had no problem signing your agreement when it served you. Did you intend to honor it when you signed, or did you gravitate toward dishonesty later on?

Whether you're "bettering your career" or not really has nothing to do with your obligation, other than the fact that it's the price of moving on, if that's what you choose to do.

The industry has developed training agreements precisely because of dishonorable pilots who take the training a company provides, then walk away. Luckily your employer didn't trust you enough to do business on a handshake. That kind of practice is generally only reserved for honest folks.

In other threads, you called it a contract. You DO know what that word means, right?

Here's another word for you to study: HONOR.

Even if it might be legal to skip out on your "Memorandum" (hmmm ... no emoticons in this forum, so I can't put an eye-roll here), it would be dishonorable for you to renege on your agreement. If your word is no good, what good are you?

You're worried about paying three months out of the 18?

If they send you a bill, pay it and move on. It's not worth the trouble to fight the possible negative effect to your credit, and it's probably not worth the cost of hiring a lawyer to see if there are any loopholes.

And yes, honor, commitment, and integrity. Pretty basic things to have if you want to be a professional pilot.

To the OP- Kudos to you for following your dream. Recommend you seek OFFICIAL legal advice from an experienced aviation attorney that is familiar with contracts. You are not the first person to be in this situation. Please Don't make a hasty decision based on unqualified "legal" advice (opinion) provded in this forum. None of the commenters (myself included) have read the contract YOU signed.

Nobody NEEDS to read it to know what the honorable thing to do is.

He entered into an agreement. He should honor it.

Any attorney who advises otherwise is a disgrace.
