Default IPA files scope grievance against UPS

The IPA was informed yesterday by the Company that it will not
turn over the Menlo flying on December 19 – as promised and required
by the Scope clause of our current contract. Under the Company's
new timetable, integration of Menlo flying into the UPS network
will not occur until July 17, 2006. The IPA has been meeting
with the Company on a regular basis since it announced the purchase
of Menlo nine months ago. At all of these meetings – most specifically
our monthly Scope meeting – the Association has been assured
by UPS Labor – the same group that we are negotiating our new
contract with – that things were on track and that IPA Crewmembers
would be taking over the Menlo flying in December. Despite these
assurances, we continued to hear rumors and reports that UPS
was signing subcontracts and preparing to outsource the Menlo
flying to others. Time and again, the Company promised the IPA
that it had sufficient lift to handle the Menlo flying in-house.
It is insulting to think that while UPS was making these assurances
to us they were also canceling A-300 orders and earnestly negotiating
Scope at the bargaining table – all the while knowing they were
setting the IPA up for a massive contract breach.

As usual UPS's timing could not be worse:

After three years we are entering the home stretch of our contract
negotiations with the Company. One of the most contentious issues
of these negotiations is Scope and our talks could very well
blow-up over the issue of outsourcing; The IPA is in the middle
of an election cycle; and

The Company waited until the eve of Peak to drop the Menlo outsourcing
bomb. This is the wrong kind of news to be delivering just before
the most critical quarter of operations.

The Impact: Under the current Menlo system UPS uses a patchwork
of 32 sub-contracted aircraft (23 – 727's, 7 – A300's, 2 – DC10's)
to fly its network. Once Menlo is fully integrated into the
UPS network the Company says it will need a total of 11 aircraft
(8 – DC8's, 3 – 727's) flying 24 lines to accomplish current
Menlo flying. The remainder of the Menlo volume will be carried
on the current UPS system. This is a significant amount of new
flying that will require more than 100 additional IPA Crewmembers.
This seven month delay will mean a loss of millions of dollars
in flying that is contractually ours.

The Solution: The IPA has no interest in a stand-alone quick
fix that is de-linked from our current contract negotiations.
The Menlo Scope breach is not a separate or isolated issue.
It is systemic, and only the most recent and glairing example
of how UPS is willing to ignore clear contractual language.

Make no mistake; UPS is legally obligated to make whole the Association
for the non-contractual outsourcing of our Menlo flying. To
that end, the Association today has filed a grievance challenging
the Company's actions.

It is imperative that we protect our jobs and prevent the Company
from outsourcing our work. We will at all times take all lawful
measures to protect our Scope.
