Not trying to be the grammar police, but the word "penultimate" is probably the number one malaproriately used word in the English language. It means almost the exact opposite of what most people thinks it means. But perhaps you ment it that way.
You may be right, he might have "meant" it that way. The spelling Cops are very similar to the grammar police - never one around when you need them.
