Yes. There was a case with a NWA pilot that went to court and he won. He had a guard/reserve job in, I believe, SD and had to live within 50 miles for it. His base was in MSP and he had a commuter pad in MSP. Those are the basics and he won his case. There is a document about this floating around......

I would do some serious research into this before I did it....... I had a second (per diem) job for a couple of years flying around a 757 that has a new owner and and looked at this seriously but I didn't think I could do it based on my situation. And before anyone asks, I had written permission from Delta to do it. It ended last summer. So sad, it paid GREAT when I could do it!!
