All depends when it was first noticed, and by who. I don't make it a habit to get close enough to smell my crew-members breath. If anybody questioned the FO after the flight, most likely law enforcement was called at that point. If I were to notice it earlier, I'd strongly suggest a sick call. If they are not willing then I guess they get what they get.
If you mention it to the individual, and he/she refuses to call in sick "hey man, I'll be fine", would YOU, as CA, allow that flight to operate? If you have prior knowledge in a crew environment, you are culpable too. I'd say certificate revocation and jail time for aiding and abetting a felon.
