My understudying is that it has been done in the past and the company can make an argument to the court on how much cost it would have to absorb to retrain the crews on the new equipment. One things is for certain, we are having allot of issues with the ATRs in DFW, we are canceling a large number of flight and often running out of equipment. Last week the broken ATRs were the only ones that didn't need inspection overnight so the ones that were airworthy had to fly to the overnights not spend the night but just return empty back to DFW because of the inspections due. Last night at one point over half the fleet was broken, and then add the weather we are hint on top of that and the operations is a mess!
