You also create a issue that you might be senior to other pilots in the category. Your could be taking flying that belongs to them. Someone might very well file a grievance and the company is sure to loose. Neither the company or ALPA want to go down this route.
The company does have some contractual options to bypass pilots moving up with limited time left. I don't however believe any of those options apply to moving down. There were only 6 mandatory displacements off the 73N in the last bid. There were not a huge number of pilots involved.
Why it is that way is not the point. Unfortunately, common sense does not often apply and if they make exceptions for this (that makes sense) then when do you stop. It sucks for you but maybe (in some small print somewhere) it should be fixed. Anyone with less than ???? doesn't have to be MD'd. Probably way below noise level compared to all the major priorities to be fixed with this contract.
