Lets see how SWAPA can deal with these issues. Labor peace and happiness is important to Kelly but to what extent? These questions above are ones that will test the very fiber of that relationship.
We don't have to "test the very fiber of that relationship", because we have already tackled these issues and written it into contractual language. This is in no way short sighted even if one truly believes SWA is in fact "maxed out in domestic markets." SWAPA has continually protected all flying that is in any way associated with Southwest. Any relationship SWA makes with other carriers MUST be approved by SWAPA. SWAPA reserves the right to decide what agreements will be in the best interest of SWAPA pilots.
2. Domestic Codeshare
Southwest Airlines will not enter into a domestic Codeshare Agreement within the fifty (50)
United States without the agreement of the Association.
5. Other Codeshare
The Company will not enter into any other Codeshare and/or Marketing Agreement (to
include far international Codeshare flying) unless expressly delineated above, without the
agreement of the Association.
“Codeshare Agreement” or “Marketing Agreement” means flying performed by another carrier
whereby the other carrier transports passengers and/or cargo pursuant to a code-share, marketing,
interline, joint venture, pro-rate, alliance or any other agreement or arrangement whereby another
carrier uses the Company’s designator codes or operates aircraft with the Company’s name, trade
name, logo, trade marks or service marks thereon or otherwise holds out to the public that the
Company or its Affiliate is performing or is otherwise associated with the flying.
