Airline managements have learned how to get almost everything they want without the dangerous "press-to-test" of imposing a contract and fighting a strike in Federal court. Just get a compliant BK judge to SAY you can do it, (even though another court would have the last word), make a token reduction in your demands, and you win.

The sad thing is that, given the pro-management bias in our court system, Denke was probably correct.
