Yea I know I never argued that.

You can "hold out" and do all sorts of flying. Ferry flights, Aerial photography, sightseeing flights, etc. They are all commercial operations (ie they would require a commercial license to do) but the exemptions for them, as well as instructing, are contained in Part 119 - CERTIFICATION: AIR CARRIERS AND COMMERCIAL OPERATORS.
Depends on the circumstances. If someone comes out and says, "hey I bought a plane and I want you to ferry it from point A to B for $250" and you say "No $300" it's illegal. When it comes to banner towing, crop dusting, aerial photography, ect. it all comes down to who rents the plane and how the transactions are handled to be considered legal. If you go rent a plane to do banner towing in they'll nail you down.
