No you're wrong. The FAA does investigate accidents and does so usually seperate of the NTSB.

Yeah, good luck getting that to stand up in court when the NTSB finds the crew not at fault They don't need the NTSB's permission but they do need proof of what they are accusing you of.
Courts don't like using the NTSB reports. The NTSB can't legally submit proof of anything.
