I completely understand that the ACP can use that as a criterion for giving his/her approval. I'm just pointing out that it's a matter of that ACP imposing his/her own restriction where a CBA restriction does not exist.

It used to be a CBA restriction, and it's interesting that we went to the trouble to remove the restriction, but now an ACP is imposing the restriction anyway.

Of course, since we don't actually have ACPs anymore ...
