Actually, the 145 side has first right of refusal for any replacement aircraft per the CPA signed with continental.
And which version do you have of the CPA? You do know that they can modify them right?
And you know that they can put out a new RFP also for more a/c?
Read the fine print and between the lines. There are loopholes.
Using whatever loophole will only bring labor strife...lots of it. I'm sure there is a contingency plan for that as well. Everyone should have a plan B in this scenario.
