This is bringing back memories of the 'ole, we can't challenge RAH buying Frontier as a scope violation because it's a "subsidiary" again. It does seem as though scope is only defendable when a very narrow set of conditions is met.

Well, if the RAH debacle set a precedence it's that in C2015 we'll make what happened a violation of the contract and then we'll give Pinnacle and any other airline an exemption to continue amending our Section 1 without us.
