That has to be a typo. Why else would it be in the timing out section and use the word "above". If they meant what you're saying they would have put M4 in the K section as K3. Hopefully the company can fix that and send out a revised copy in time.
Anytime there is any ambiguity in the contract the company has won the grievance so this would no doubt result in the company being able to take away guarantee. The company can't revise it as it has already been submitted as their LBFO. This is the LBFO that was sent to the mediator and the union.
