Bargaining for the deal? The communication in question originated AFTER the deal had already been bargained, and that deal is now in the form of an LOA we get to vote on. The communication is to persuade us why we should vote for the LOA -- because if we don't, there may be lawsuits.

TC, I was referring to the concept in general as I believe the issue of potential litigation if the actions warranted was brought up in some of the messages prior to the LOA TA, specifically a Chairman's Message, but I could be wrong.
