This is fair and equitable. A pound is a pound. What is unfair is charging a small person the same as a large one, as the small person winds up paying more per pound than the large person.
It has nothing whatsoever to do with "discrimination", unless it be discrimination against smaller people.
This is already a matter of common practice, as a small person spends less on food than someone who is much bigger (regardless of body fat percentages).
