Exactly. It's not about what they will most likely do, it's about what they can do. That's why it's called a contract.
Would you negotiate for something you never intended to use? And ALPA is like "I doubt they will ever use that, so sure, they can have it".
I have said it before. Might, should, may, probably, best attempt and phrases like this have no place in a contract. They create loopholes.
