I think it's simple.

If they allow anyone that's over age 60 at the time the rule goes into effect(i.e. over 60 F/E's) to go back to a front seat, all the lawsuits that are going to follow from the already retired guys, would have that much more validity. Whether they worked for an airline that has F/E's or not.
