I hadn't really thought about it until PD said it but since the NTSB is not conducting a criminal investigation then is that why the facts can stream out? And imho it isn't accurate to say the pilots are being tried in the court of public opinion.
Now if the pilots intentionally crashed the airplane then it gets kicked over to the FBI and we hear nothing from that point forward. I mean if you look up the 9/11 crashes it basically says SEE FBI...

The Safety Board provided requested technical assistance to the FBI, and this material generated by the NTSB is under the control of the FBI. The Safety Board does not plan to issue a report or open a public docket.
