She did not rule this. She said this in her rambling diatribe, but it makes no sense. It would completely undermine the intent of the law. Plus, if that were the case then this whole argument is moot! Under her premise even with a win for AOL the APA could come in and do whatever it wants anyway!

I read it the same way, R57. The part where she goes off the rails against USAPA is where she is explicity stating that this is her "understanding" of the MOU and MB process. It's not at all an order, it's a statement of how she expects the process is going to go. The footnoot is to the point. She has no input other than the things she explicity ordered. What she ordered is only this: 1) Case was ripe but no DFR has occurred, and 2) West pilots do not get separate seniority representation at the MB process.
