The courts are keeping the fight going. They keep putting comments in with their rulings that both side read to mean they are in the right and just that close to winning. Just keep the fight going on a little longer, keep the money flowing and we have a win!

Sometimes battles like this develop an inertia that is impossible to overcome until there is a total defeat of one side. Then often the other side realizes what that defeat cost.
