What exactly have we "done"...? Legal is legal. The West had their trial on the merits and they got zip, zero, nadda.
They were told about the risk by their lawyer at Wye River and they fired him, then poured money into another lawyer that tickled their ears, and he has been a total loss.
The West seems to have an implicit assumption that if they can just weasel their way into the MB arbitration then they will be able to persuade an arbitrator to award them "damages" for assumed "injustices" they failed to prove in court.
