I would also like to see the arbitrator attach a higher penalty via a additional raise if they do not come into compliance in the next 36 month cycle.

I think this is achievable in the negotiation/grievance process. Carl mentioned ending the JV but I doubt an arbitrator would force the company to stop commerce. The punishment doesn't fit the crime and it doesn't even really help Delta pilots.
It's my understanding that while an arbitrator could certainly rule for damages in almost anyway they see fit, they tend to avoid "coming down with the throw hammer" on one side or the other as a matter a self preservation. Ultimately the arbitrators on the standing list used for the Delta Pilot's System Board of Adjustment (11 neutrals total) are selected by both parties. If an arbitrator is viewed as going off the reservation by one side or the other, they could find themselves either no longer on the list or consistently one of the first ones struck from the list when choosing a neutral for a specific case. If you don't get selected, you're not getting paid. Granted, these same arbitrators are used at virtually every airline and Delta is certainly not the only source of income by any stretch, but the logic still applies.
For the record, I much prefer the throw hammer with the JV issue at hand.
