This is false. The erj MEC passed an MOU to bring ASA furloughs.

Re: Hiring of ASA Furloughed Pilots

THIS MEMORANDUM OF UNDERSTANDING made and entered into in accordance with
the provisions of the Railway Labor Act, as amended, is by and between ExpressJet Airlines, Inc.
(hereinafter referred to as “the Company” or “XJT”) and the air line pilots in the service of XJT, as
represented by the Air Line Pilots Association, International (hereinafter referred to as “ALPA” or
“the Association”).

WITNESSETH:

WHEREAS, Atlantic Southeast Airlines (“ASA”) has notified the Association of its intent to
reduce staffing at ASA; and

WHEREAS, the parties desire to offer future vacancies at XJT to furloughed ASA pilots;

NOW THEREFORE, the parties have agreed to establish the process for preferential hiring
of ASA furloughed pilots at XJT as follows:
A. Except as otherwise provided below, a furloughed ASA pilot who accepts a pilot position at
XJT will be treated as a new hire pilot.
B. This MOU is not applicable to an ASA pilot on voluntary furlough.
C. Hiring Process

1. Pilot positions at XJT will be offered to furloughed ASA pilots in ASA seniority
order after all furloughed XJT pilots have been offered recall IAW MOU 24.

2. A furloughed ASA pilot will not be required to interview.

3. A furloughed ASA pilot who accepts a pilot position at XJT will not be required to
resign their position at ASA.

4. A furloughed ASA pilot who declines an offer of a pilot position at XJT will be
eligible for a future offer of employment at XJT for 6 months following the date of
his furlough.
D. Seniority and Longevity
1. A pilot furloughed from ASA will be assigned an XJT seniority number IAW the
Agreement.
2. A pilot furloughed from ASA will retain and use his ASA longevity for all purposes
under the Agreement.
3. A pilot’s position on the Integrated Seniority List will be determined IAW the
Transition & Process Agreement.
E. Transition from ASA to XJT
1. A pilot will be given a minimum of 4 days free from duty before training. If the
granting of such days results in a conflict with a class date, the pilot may waive
such days or elect to take the next available class date.
2. A pilot will be compensated for training as an XJT recall as provided in paragraph
14.H. of the Agreement.
3. Provided that a pilot begins training at XJT within 7 days of his last day of active
service at ASA, his MMG will not be prorated due to the transition. XJT pay status
will begin the first day of training.
4. Provided that a pilot begins training at XJT within 30 days of his last day of active
service at ASA, insurance benefits will be available without interruption. A pilot
may be subject to a waiting period for supplemental life insurance and/or disability
insurance as required by the plan(s).
5. A pilot will be eligible for participation in the Company retirement plan from his first
day of pay status.
6. Benefits accrued at ASA will be converted to XJT levels.
7. A pilot will retain any vacation dates for 2012 that have already been awarded.
Accrued vacation for 2012 that has not been awarded will be assigned from
vacation open time after the completion of the 2012 vacation award.
8. A pilot will not be provided moving expenses as a result of this MOU.
9. All pilots hired IAW this MOU will be provided hotel accommodations during
training, if requested.
10. A pilot will be on probation IAW the Agreement based on his ASA hire date.
11. Expenses incurred by the pilot necessary to bring his uniform into compliance with
the combined uniform standards will be reimbursed by the Company.
F. Duration
1. This Memorandum of Understanding will be effective upon execution and remain
in full force and effect for a period of one year from the date of execution.
2. Upon request, the Parties will meet and confer one month prior to termination of
this Memorandum of Understanding to discuss its extension. Any extension will
be in writing and subject to the approval of the Parties.
In WITNESS WHEREOF, the parties have signed this Memorandum of Understanding on
the 16th day of November, 2011.
