Something else must've happened as there is nothing in PTS regarding MSA. If ATC is vectoring you, altitude is completely their perogative.
If he was failed for that, he can appeal and will definitely win.
That is the entire story as conveyed to me. He went to CBM approach control and had the tapes pulled, I don't know the status of his appeal. I was told he asked the San Antonio FSDO for an opinion and they sided with the examiner; however, it was not their jurisdiction so it was nothing more than an opinion. I don't get it.
Overseas I wouldn't go below MSA because who the heck knows the skill level of your controller. In the USA I don't even think twice about descending to an altitude issued by ATC.
