I think it should be done by age as well. Its clearly not lawsuit material because many other places still do it that way and no one is getting sued. Its also the right thing to do for the reason you mentioned. But I don't see one second of negotiating time from either side being spent to even turn the contract to that page to see daylight.
+1 agreed..... Done by age at current employer. No lawsuits there. I was second most junior and felt fortunate to be at current place and being young. The older gentlemen/ladies should have something to benefit from. They won't be able to work as long as I will.
I'd be quite happy to be the most junior in a newhire class at DL! Just hoping to interview in near future.
