Since nobody in ATC really cares, and most are ignorant of the rule, it's likely no one will ever get in trouble over this unless they admit to it or get in enough glue that someone dumps data from the airplane.

In the U.S., controllers may approve higher speeds in Class C and D airspace. The situation cited above is not a valid clearance.
