Most FOs now have a PIC Type Rating, which entailed taxiing and a rejected takeoff. Would it be legal to taxi it on in after switching seats? You would be exercising your In Command authority. (I think I'd ACARS the Duty Pilot for some top cover before doing it myself though).
I believe the FO declared an emergency shortly before landing. Pretty much covers anything he would have done.
