I believe your question is rhetorical? If so, my apologies for responding in kind.
The CBA cannot "force" or ultimately "waive" an employee's right to privacy. It CAN, however, provide "CONDITIONS" contained within the CBA which make it extremely difficult (i.e. impossible) to remain employed at said Company, without offering evidence of "leave without cause". (e.g. The FOM doesn't "FORCE" you to wear your uniform a certain way, but makes it extremely difficult for you to remain employed if you so choose to wear it how you would choose.)
