No one ever said anyone MUST accept that premise... Not even the 9th. If no one can reject that premise and argue "fair and equitable" is something different, then there is no need for an arbitration.
We are talking about analyzing the west proposal, nothing more. For the west proposal to be properly assessed you MUST start out with the Nic. that is the only way the west proposal works and must be looked at and judged on that light. Now no one is saying the arbs can't do as they please and totally or partially disregard the Nic, but if they do then the west proposal does not work and must be redone.
