I think they already have. One of our guys was flying the TECKY ONE (depreciated by TECKY TWO last month I think - looks like the same constraints however) departure out of KSJC. The plate calls for a speed at or below 230K at the first way point. When loading the departure procedure, the FMS obediently loads 230K. Guess what? This airspace is under the shelf of the KSFO Bravo airspace. 200K max. Apparently nothing was said about it on the radio and a couple of weeks ago he got a letter. Sigh.
