If West does not believe the PA applies to them then this process should stop, because as you say it is an important legal distinction that needs to be resolved. Otherwise this is not a fair and equatable process between the three groups.
The West is just whining. Freund was absolutely hilarious in his three page answer to the question of being bound by the PA... and HE SAID "Whether we're bound by the agreement or not, frankly, is not for me to say."
The West whined that the BOA had no authority to consider telling APA to establish an East Committee. The West whined to Silver in an attempt to overrule the BOA.. But every time the BOA makes a decision the West won't do jack sheet about it. All three committees are bound to the PA to whatever extent the BOA says, and that will be that, whining or not.
None of the committees negotiated or signed MB either. TFB. The BOA has it all now. All of it. The whiners won't have any positive impact on the outcome.
