The only thing that status quo applies to are things signed for in the PEA. Like, they can't just change the pay rates... but they can change the FSM all day because the PEA says Per the FSM. Not as it was, but as it is written... today via the email you just got.
Not entirely accurate. Status quo is status quo across the board. If there were any drastic changes in the FSM it would absolutely be a status quo violation. Just as if we were a company that just voted in a union whose pilots never signed anything.
Voting in the union basically made the FSM part of the PEA if you want to think of it like that. They can't change it any easier than they can change the PEA.
Now it would have to be pretty big change for ALPA to complain to the NLRB because I believe it's a long process. But it's a long process for the company to justify it as well and the lost goodwill is priceless to both sides.
