ENY is setting flaps just prior to takeoff in an attempt to keep the flaps free of contamination during the taxi out, specifically from the mains throwing snow and slush into the flaps. They don't want jammed flaps. If you get de-iced due to frost or something or there's no reason to expect stuff getting in the flaps they get set for takeoff normally.
