Amendments to the MEC policy manual

WHEREAS: the Delta Pilot Working Agreement may be modified by several methods.

WHEREAS: the Delta pilots desire to have timely notification and final approval of all modifications made to the Delta Pilot Working Agreement.

WHEREAS: the current language of the MEC policy manual is as follows:

SECTION 9 − NEGOTIATION AND RATIFICATION OF AGREEMENTS
B. Ratification of Agreements
1. MEC Ratification Policy
a. Collective bargaining agreements that have been approved by the MEC and result from negotiations undertaken pursuant to both Section 28 of the PWA and Section 6 of the Railway Labor Act that both resolve all Section 6 issues and conclude Section 6 negotiations shall be subject to membership ratification. All other agreements shall be subject only to MEC ratification unless the MEC determines that an agreement should be subject to membership ratification.
2. Ratification Procedures
b. No agreement will be submitted to the membership for ratification unless it has first been approved by the MEC.

WHEREAS: the current language of the MEC policy manual is inadequate to ensure member ratification of all modifications of the Delta Pilot Working Agreement.


THEREFORE BE IT RESOLVED: the Delta pilots desire the following amendment to the MEC Policy Manual language:

a. All agreements, including but not limited to, Collective bargaining agreements, Letters of Agreement, Memoranda of Understanding, and negotiated settlements, that have been approved by the MEC and result from negotiations undertaken pursuant to Section 28 of the PWA or Section 6 of the Railway Labor Act shall be subject to membership ratification.
2. Ratification Procedures
b. No agreement will be submitted to the membership for ratification unless it has first been recommended for approval by the MEC.




Profit Sharing

WHEREAS: A recent new communication titled the Duty Officer Log 16-01 stated:
Annually, representatives from your MEC administration, joined by a subject matter expert from ALPA's Economic & Financial Analysis Department, review the methodology and calculation of employee awards. This profit sharing audit takes place after the Company releases its “annual audited consolidated financial statements,” and before you receive your payout. We expect to have more specifics during that meeting with the Company.

WHEREAS: The membership desires access to the information discovered during these audits from the years 2012, 2013, 2014 and 2015.

WHEREAS: The Delta management expressed a change in accounting practices during the question and answer period of the annual Investor Day presentation. These changes have the potential to reduce both PTIX and the amount paid to pilots in annual profit sharing.


THEREFORE BE IT RESOLVED: The Delta pilots direct the MEC to publish a report detailing the PTIX calculations and division of funds from the profit sharing pool for each individual year 2012, 2013, 2014 and 2015. The report will include a full accounting of the GAAP pretax profit and all items both additions, and all one-time expenses not included in PTIX as defined in the PWA. This report must also include details for division of the profit sharing pool as described in PWA including the pilots’ percentage share of funds and all pertinent information about all recipient groups’ portions.
