That could easily start a jumpseat war. I don't think the JS committee would be very happy about that. While it is the captain's discretion, there should be a pretty damn good reason to deny someone. But if it's available, the jumpseater abides by all JS protocol and asks politely if it's okay to catch a ride, if captains willy nilly just deny the JS, that would be very bad for this industry, hence why JS committees exist.
