Unlikley. You could sue, but probably not win.
I've interviewed and hired many people, and I remember the law well...Equal Opportunity applies ONLY to those specifically named in the law. I'm pretty sure it didn't say anything about gojetters...or any other variety of scab.
It would probably be legal for a company to not hire a gojetter simply based on the fact that he worked under circumstances at odds with the hiring company's philosphy.
But it would never come to that...anyone who declines a gojetter is not going to write that down in the interview notes, lol. They will just downgrade the subjective grading for interpersonal skills or something like that. "I wasn't there, nobody saw me do it, you can't prove a thing!"
On a lighter note...I may be heading to ORD for a while. Perhaps I'll get to tell a gojet JSer to pound sand
