The "tier" system is all games. Not sure what they're trying to achieve, but at DL, everything is intentional.
You're reading WAY too much into this. They already admit the "tiers" and also admit that there are many factors in them, like college GPA and charity/vol work etc. There is zero liability risk for "admitting" someone went off the end of the runway but was "tier two" because they got a D in college chemistry 20 years ago or never built a Habitat house.

That's as redonk as saying an airline is liable if they don't hire a pilot flying for one of their regionals. Non issue, and never will be one.
