Their plan has been a inter Europe low cost carrier. No trans Atlantic ever mentioned. I believe the company is either in compliance or within one flight. They have been above 48% for the last year. 48.5 is the compliance limit. There were several months where they were above that. There should be a scope update on the Dalpa website soon.
If AF started a new operation and shifted Atlantic flights to that operation it would put the company into compliance with just one route shift if the new airline was not in the JV.
