I think the JV agreement probably has an alter-ego clause to prevent either company from circumventing the JV and putting it in danger. This is a complete guess but JVs in any industry have outlines for controlling actions that might threaten the venture.
He was saying if it was not included in the JV then it wouldn't matter. I don't care how much a foreign airline wants to fly to the US (except the duel subsidized ME3s or scab of convenience NAI types) the issue WRT our JV scope is airlines within our JV. If Lufthansa adds 10 flights tomorrow, the Delta PWA isn't effected because they're not in the JV. Same thing for an AF spin off, provided they aren't in it either I would assume.
