I should have been clearer and said someone who bids and is awarded/should have been awarded but wasn't soley for the FAR reason.
What did UAL do back in the mid 90s when they had F/Os who didn't qualify for an ATP but were awarded B777 F/O slots because they had the seniority to do so? (I know it happened, just don't recall the answer).
I understand your point, but if you're not legally qualified to hold the seat, why would you get paid for it? If you don't have a box checked, especially in the FAA's eyes, you're not qualified, therefore not eligible to bid and hold the position.
