Yes, they could consider that income IF they go back to court to recalculate.

But my point is that he may need to get a second job to meet the responsibilty he took on when he brought two kids into this world. If they reduce the child support down to his guarantee, assuming that is a ratable reduction from the 160 hours per month to his 75 hour per month guarantee, he's going to be contributing less that $500 a month to raise two kids. That does not go very far unless you live in a very low COL area.
