We don't have to like it, but there is a very real legal precedent known as status quo. Ask APA over at American. Cost them literally millions of dollars in fines. Ask the Delta 49ers. Status quo is viewed by the courts as the established 'norm' of operations. Airlines can easily pull out loads of statistical data that point to what this norm is.
For instance (hypothetically), if a pilot group has consistently thrown bags alongside the rampers in order to hasten turns, even though there's no mention of it in the CBA, and then quits doing it in order to hasten negotiations (statistically prove able), the airline could take them to court. It would sound almost exactly like what Spirit filed yesterday. 'We had to cancel x number of flights because we couldn't turn a/c fast enough based on current staffing levels. These staffing levels were set based upon established statistical pilot practices of helping to throw bags, practices they've suddenly and unilaterally suspended because they're upset with the pace of bargaining. Furthermore, the pilot group is harassing the few remaining bag throwers.'
Believe me, I wish the NMB hadn't pulled our teeth out. The deck is stacked against us, but we need to let the guys who WE elected, with all of the experience and resources ALPA has, fight this fight. If we start harassing guys and acting like keyboard warriors on here, we shoot them in the foot. Don't think management pays attention? Read the Spirit lawsuit and see how many times APC posts are directly quoted. Even if the Spirit MEC prevails, how long do you think this will sidetrack negotiation efforts? How much money will this defense cost them? Work smarter AND harder. Its easy to be a keyboard warrior. Don't let the mob mentality set us back 6-12 mos.
