All new hire Pilots who are type rated pursuant to
subparagraph 11.V.16. above and subsequently resign
within twelve (12) months are responsible to reimburse the
Company for training costs associated with Pilot’s Initial
Training in the amount of twelve thousand dollars
($12,000.00). This amount will be prorated over the twelve
(12) months from completion of training at the rate of onetwelfth
(1/12) per month on payroll. A Pilot who resigns
following a Company announcement of a Pilot layoff which
(i) includes the Pilot, or (ii) the Pilot could reasonably
presume would include the Pilot, will not be required to
reimburse this cost."
Past practice was they had you sign a sheet on day 1 of employement. I'd fight it if you didn't sign anything as past practice can trump what's written in the contract. They can't just ignore part of the contract and then start enforcing it when they choose.
